Terms of use
of the beta
/ Version: 27 October 2026
This is a translation. The German version is legally binding.
01Scope, provider and customers
(1) These terms apply to the use of moddl, an application for editing IFC models (the “Service”). The contracting party is the provider named in the legal notice (“we”).
(2) Mandatory statutory provisions in favour of consumers remain unaffected.
(3) For accounts used to process personal data of third parties, the data processing agreement also applies. Users’ deviating terms do not apply, even if we do not object to them.
02Beta phase and service
(1) moddl is in a beta phase that is expected to last until 30 June 2027. We may extend the beta or end it earlier under clause 10. During the beta, use is free of charge.
(2) Without an account you edit a sample model or an empty project. With a free account you can upload your own IFC models within the limits stated in the Service from time to time (such as file size and storage space). We may adjust these limits.
(3) The beta is a test version. It is provided without any assurance of particular properties, without promised availability and without entitlement to support, bug fixes or particular functions. Quantities, dimensions and other computed values come from the model and may contain errors.
03Account
(1) There is no entitlement to an account. Your details at registration must be correct.
(2) Keep your credentials and the access keys of connected agents secret and treat them like a password. You are responsible for actions through your account and your agents, as far as you are accountable for them.
(3) We may delete accounts that have not been used for 24 months, with all their contents, after notifying the email address on file beforehand.
04Your content
(1) The rights in your files remain with you. You grant us the non-exclusive, free-of-charge rights necessary to provide the Service, in particular to store, copy, convert, edit and make them available to you, to members of your project rooms and to agents you have connected. The grant ends when the content is deleted.
(2) Without an account your workbench is held only temporarily and discarded 24 hours after last use at the latest, possibly sooner. Download results beforehand.
(3) With an account your workbenches remain stored until you delete them or the contract ends. Clause 3(3) remains unaffected. The privacy policy gives details.
(4) Backing up your data is your responsibility. We owe no data backup. You can export for as long as the Service is available.
05Permitted use
(1) You may only upload files to which you have the necessary rights and whose processing does not breach any duty of confidentiality. Do not upload models of security-sensitive facilities, such as critical infrastructure, the judiciary, the police or the military.
(2) In particular, the following are prohibited: illegal content, attacks on the Service or other users, circumventing limits, access or security measures, automated access outside the intended interfaces or to an unusual extent, and systematically harvesting the Service to build a comparable offering.
(3) You decide, and are responsible for, which AI provider you connect and which data you make accessible to it through moddl.
(4) You indemnify us against claims of third parties based on a breach of this clause for which you are accountable, including reasonable costs of legal defence.
06Duty to check
Check quantities, dimensions and every change before you pass on a model or result or base decisions on it. moddl does not replace professional review.
07Handling content (Art. 14 DSA)
(1) We do not monitor content generally. We receive notices of illegal content through the report form in the legal notice and at info@moddl.site and review them. We check automatically only technical features, such as file format, size and access frequency. A person decides on restrictions because of content.
(2) Possible measures are blocking or removing content, restricting functions, and blocking or terminating an account. Those affected receive a statement of reasons under Art. 17 DSA. You can write to us about it at any time. Recourse to the courts remains open.
08Restriction and blocking
We may restrict or block access or content if you breach these terms or there is a justified suspicion of it, if the security or integrity of the Service is at risk, or if an order of an authority or court requires it. We choose the mildest suitable means and act without advance notice where necessary. Clause 7(2) applies accordingly.
09Changes, discontinuation and termination
(1) We may change the Service if there is a valid reason, in particular technical development, adaptation to the legal position or requirements of authorities, security reasons or changes at our service providers, and the change is reasonable for you.
(2) We announce material restrictions and the discontinuation of the Service within a reasonable period, as a rule at least two weeks in advance, by email or in the Service. For good cause, such as a security risk, a legal or official requirement or the loss of an indispensable service provider, we may shorten the period or act without announcement, as far as unavoidable. Until discontinuation you can export your models.
(3) You can end the contract at any time by deleting your account. We may terminate with a notice period of two weeks. The right to terminate for good cause remains unaffected.
(4) When the contract ends, for whatever reason, we delete the account with all its contents 90 days after the end of the contract at the latest. Until the end of the contract you can export your models.
10End of the beta
(1) We announce the end of the beta and the terms of the follow-on service in good time, as a rule at least two weeks in advance. There is no entitlement to continuation of the Service, in particular to a free continuation.
(2) Your account remains if you accept the terms of the follow-on service. Otherwise the contract ends with the end of the beta. Clause 9(4) applies.
11Transfer of the contract
We may transfer this contract, including the data processing, to a legal successor, in particular to a company that continues to operate moddl. We tell you of the transfer in advance. In this case you may end the contract at any time with effect from the time of the transfer.
12Liability
(1) As far as use is free of charge, we are liable only for intent and gross negligence.
(2) Otherwise we are liable without limit for intent and gross negligence. For slight negligence we are liable only for breach of essential contractual obligations, that is, obligations whose fulfilment makes proper performance of the contract possible in the first place and on which you can regularly rely, and limited to the typical, foreseeable damage.
(3) Liability for injury to life, body and health, under the Product Liability Act, from giving a guarantee, for fraudulently concealed defects, and as far as the law mandatorily requires, remains unaffected.
(4) For loss of data we are liable, within the scope of paragraphs 1 and 2, only for the effort that would have been needed to restore it had you made proper, regular backups.
(5) These rules also apply to our partners, employees and vicarious agents.
13Acceptance and changes to these terms
(1) With an account you accept these terms before your account first receives content or access. Without an account, you accept at your first own write in your workbench, once per session. The privacy policy describes the proof.
(2) We submit changes to these terms to you for acceptance. Until you accept, you can view and export your content but not change it. If you do not accept, we may terminate the contract under clause 9(3).
(3) We send notices to the email address on file or show them in the Service.
14Governing law and place of jurisdiction
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction for disputes with merchants, public-law legal entities and public-law special funds is Stuttgart. Towards consumers the choice of law applies only as far as mandatory provisions of the state of their habitual residence do not conflict.
